Terms and Conditions for Alps Accommodation Managed Properties

Terms and Conditions (T's and C's) for: Alps Accommodation, 35 Clos du Clevieux, Chef-Lieu, 74340, Samoens, France hereafter referred to as ‘Alps Accommodation’.

1. The group leader is responsible on behalf of all other members of the group for all matters relating to the booking.

2. "The group" refers to all persons booked to stay in the accommodation being either, bed and breakfast, semi catered or self catered. The group includes any change of names to the original booking.

3. If at any time prior to the stay the group leader pulls out of the booking, Alps Accommodation must be notified by in writing by the original group leader and a new booking confirmation and T's and C's form must be signed by a new group leader and returned to Alps Accommodation before embarking on the holiday.

4. In case of dishonoured payment the group leader will be contacted to make payment by other means, to be received by the owner within 7 days (or immediate payment if the group is due to start the holiday in less than 7 days). Failure to do this will mean automatic cancellation of the booking.

5. Cancellations must be notified to Alps Accommodation by the group leader as soon as possible in writing. Cancellation charges with be levied as follows: more than 6 weeks before arrival date - the deposit, 4-6 weeks - 50%, 2-4 weeks - 75%, less than 2 weeks - 100%.

6. Due to circumstances beyond Alps Accommodation’s control, i.e. acts of God, it may be necessary to make alterations to a confirmed booking or to cancel the booking completely. Whilst Alps Accommodation will make every effort to ensure this does not happen, if it is unavoidable Alps Accommodation will contact the group leader as soon as possible. In this instance Alps Accommodation will endeavour to make alternative arrangements for accommodation of the same value if available, or offer a full refund of any monies paid. No other compensation will be offered.

7. Any loss or damage wheresoever or howsoever caused or arising by the group leader or members of the group to the property, grounds and outbuildings must be paid in full within 14 days of confirmation of the amount.  

8. There will be a standard 50 Euro service fee added to the cost of any breakages for the time taken to purchase and install its replacement. There will be a 25 Euro service charge added to the cost of the postage for any items left and required to be returned by post.

9. It is up to the group leader to ensure that the self catered accommodation is left clean and tidy on departure. Full instructions are in the property. If this is not the case an additional charge for unreasonable cleaning time may be charged.

10. Alps Accommodation has the right to terminate without notice and liability the holiday of any group member whose behaviour is such that it is likely to disrupt the enjoyment of others on holiday or cause damage to the property or any third party.

11. It is up to the group leader to ensure that each member of the party is responsible for the safety of all their own personal possessions, documents and equipment. No responsibility or liability is or will be accepted in respect of such items.

12. It is up to the group leader to ensure that each member of the group has all their own necessary medical and travel insurance documents to cover themselves fully including damage to the property, before embarking on the holiday. No responsibility is or will be accepted by Alps Accommodation in respect of any such failure to insure wheresoever or howsoever arising.

13. Alps Accommodation does not accept any liability wheresoever or howsoever arising or pay compensation for:

a) any event which could not foresee or avoided. Such events include war, threat of war, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions and fire, disruptions/noise caused by local building projects outside Alps Accommodation properties; b) any cancellation, loss, delay or costs wheresoever or howsoever arising or connected with adverse weather or traffic conditions, avalanche, mud slips, slides and snow conditions and the effect any of these may have on travel arrangements, accommodation and activities; c) limitations imposed by resort authorities, ski-lifts, ski school or ski hire operators; d) travel arrangements made by the group or on behalf of the group.

14. Alps Accommodation does not accept any liability for personal injury or death wheresoever or howsoever arising caused to any visitor and/or any member of the group for their duration of stay. This is not intended to exclude any statutory rights the group and/or visitor may have. This agreement and any proceedings thereunder are to be governed by English Jurisdiction.

15. Alps Accommodation reserves the right to increase or decrease the price of unsold holidays at any time.

16. The price indicated corresponds to a rental from 5.00pm on the arrival day, to 10.00am on the departure day.  Any earlier arrival times or later departure times are to be requested by the group leader, by email and are at Alps Accommodation discretion and cannot guaranteed.  Alps Accommodation reserve the right to charge an additional fee for early arrivals and late departures

17. A person who is not a party to this Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Contract provided always this does not affect any right or remedy of a third party which exists or is available apart from this Act.

18. For safety & insurance purposes a non smoking policy is adopted throughout all accommodation offered by Alps Accommodation. In addition, Alps Accommodation does not accept pets.

19. In the unlikely event of any problems occurring during your holiday, a complaint must be made immediately to Alps Accommodation so that we have the opportunity to rectify the problem. Any complaints made after departure on points we were not made aware of in resort will not be considered.

20. Alps Accommodation is not responsible for any illness or accident occurred as a direct or indirect result of using the hot tub, sauna or swimming pool at those properties which have one. Usage is entirely at the guests own risk. All party members agree to abide fully by the hot tub user instructions in the property manual.

21. Transfers booked through Alps Accommodation Transfers are operated and run by S.A.R.L GoMassif. Alps Accommodation will not be held responsible or liable for any problems relating to the transfers.

22. Alps Accommodation do not take responsibility for flexible catering by any third party.

23. All descriptions on this website are given in good faith and believed to be correct. This is in relation to all aspects including activity pricing and information.

24. Where WiFi internet access is offered neither Alps Accommodation, nor the owner accept any liability if this is not available for all or some of the rental, and no refund will be offered where this is the case.

25. For the avoidance of doubt in the event of any conflict the provisions of the T's and C's prevail.

26. All users of this website agree that the English language version prevails over all translations in another language.

Conditions Générales Client Alps Accommodation

Exemplaire des Conditions générales appartenant à Alps Accommodation, 35 Clos du Clevieux, Chef-Lieu 74340, Samoëns, ci-après dénommés « Alps Accommodation ».

1. Le responsable du groupe répond des autres membres du groupe pour tout problème relatif à la réservation.

2. Le « groupe » désigne toutes les personnes ayant réservé pour séjourner dans le logement, que ce soit avec petit-déjeuner, en demi-pension ou en logement indépendant. Le groupe inclut tout changement de noms apporté à la réservation originale.

3. Si, à tout moment, le responsable du groupe décide de ne pas partir, Alps Accommodation doit en être informé par e-mail ou par téléphone par celui-ci et une nouvelle confirmation de réservation et de nouvelles conditions générales doivent être signées par un nouveau responsable de groupe, puis renvoyées au propriétaire avant le début du séjour.

4. En cas de non paiement, le responsable du groupe sera invité à effectuer le paiement par un autre moyen afin que le propriétaire le reçoive dans un délai de 7 jours (ou immédiatement si la période de location débute dans moins de 7 jours). Tout manquement à cette condition entraînera l'annulation automatique de la réservation.

5. Les annulations doivent être notifiées par écrit à Alps Accommodation par le responsable du groupe dès que possible. Les frais d'annulation correspondront à la caution en cas d'annulation plus de 6 semaines avant la date d'arrivée, à 50 % du montant total pour toute annulation effectuée 4 à 6 semaines avant la date d'arrivée, à 75 % pour toute annulation effectuée 2 à 4 semaines avant et à 100 % pour toute annulation effectuée moins de 2 semaines avant la date d'arrivée.

6. Certaines circonstances indépendantes de la volonté d'Alps Accommodation, telles que des catastrophes naturelles, peuvent entraîner la modification d'une réservation confirmée ou l'annulation pure et simple de la réservation. Alps Accommodation fera tout son possible pour éviter cette situation. Si cela s'avère inévitable, Alps Accommodation contactera le responsable du groupe dans les plus brefs délais. Dans ce cas de figure, Alps Accommodation s'efforcera de trouver un logement de même valeur disponible ou proposera un remboursement de toutes les sommes payées. Aucune autre compensation ne sera offerte.

7. Tout dommage ou perte occasionné par le responsable ou les membres du groupe à la propriété, au terrain et dans les communs doit être remboursé dans son intégralité avant 14 jours du départ.

8. Il y aura des frais de 50 Euro ajoutés au coût de toute casse du temps pour acheter et installer son remplacement. Il y aura un frais de service de 25 euros ajoutés au coût de l'affranchissement pour les articles laissés et qui doit être retourné par la poste.

9. Il incombe au responsable du groupe de s'assurer que le logement indépendant est propre et rangé avant de partir. Les instructions sont dans la propriété. Dans le cas contraire, des frais supplémentaires seront déduits de la caution pour le nettoyage du logement.

10. Alps Accommodation se réserve le droit de mettre un terme sans avis préalable ni responsabilité au séjour de tout membre du groupe dont le comportement est susceptible de déranger d'autres vacanciers ou de causer des dommages à la propriété ou à des tiers.

11. Il incombe au responsable du groupe de s'assurer que chaque membre du groupe assure la sécurité de ses biens personnels. Aucune responsabilité n'est, ni ne sera, engagée vis-à-vis de ces biens.

12. Il incombe au responsable du groupe de s'assurer que chaque membre du groupe possède les documents d'assurance voyage et santé y compris les dommages à la propriété, nécessaires avant d'effectuer le séjour. Aucune responsabilité n'est, ni ne sera, assumée en cas d'absence d'assurances.

13. Alps Accommodation n'assume aucune responsabilité ni aucuns frais découlant : a) de tout événement que le propriétaire n'aurait pas pu prévoir ou éviter, notamment les guerres, les menaces de guerre, les conflits civils, les actes terroristes, les conflits industriels, les catastrophes naturelles ou nucléaires, les mauvaises conditions climatiques et les incendies ; b) de tout retard, annulation, perte ou coût découlant ou lié à de mauvaises conditions climatiques, à des problèmes de circulation, à des avalanches, à des coulées de boues, à des glissements de terrain ou à de la neige, ainsi qu'aux conséquences de ces situations sur les préparatifs, le logement et les activités du séjour ; c) des limites imposées par les autorités de la station, les responsables des remontées mécaniques, des écoles de ski ou des loueurs de ski ; d) des préparatifs de voyage effectués par le groupe ou au nom de ce dernier.

14. Alps Accommodation n'est en aucun cas responsable de toute blessure ou de tout décès d'un visiteur et/ou d'un membre du groupe pendant la durée du séjour. Cette clause n'affecte aucunement les droits statutaires du groupe et/ou du visiteur. Le présent contrat et toutes les mesures stipulées ci-dessous relèvent des tribunaux anglais.

15. Alps Accommodation se réserve le droit d'augmenter ou de diminuer le prix des séjours non vendus à tout moment.

16. Le prix indiqué correspond à une location à partir de 17h00 le jour d'arrivée, à 10h00 le jour du départ. Toutes les heures d'arrivée plus tôt ou plus tard, les heures de départ doivent être demandée par le chef de groupe, par courriel et sont à Alpes Hébergement discrétion et ne peuvent pas garanti. Alps Accommodation réserve le droit de facturer des frais supplémentaires pour les arrivées anticipées et les départs tardifs.

17. Conformément à la loi Contracts (Rights of Third Parties) Act de 1999, toute personne non signataire du présent Contrat n'a pas le droit de faire valoir les termes du présent Contrat à condition que cela ne porte atteinte à aucun droit ou recours d'une tierce partie octroyé par cet Act ou par une autre loi.

18. Pour des raisons de sécurité et d'assurance, il est interdit de fumer dans le bâtiment. En outre, Alps Accommodation n'accepte pas les animaux.

19. En cas d'éventuel problème durant votre séjour, une plainte doit être immédiatement introduite auprès d'Alps Accommodation. Aucune plainte introduite après le départ ne sera prise en considération.

20. Alps Accommodation n'est pas responsable de la maladie ou de l'accident est arrivé comme un comme le résultat direct ou indirect d'utiliser le Jacuzzi à ces propriétés qui l'un ont. L'usage du le Jacuzzi est entièrement aux invités possède le risque. Tous les membres de parti consentent à demeurer entièrement par les instructions d'utilisateur de le Jacuzzi dans le manuel de propriété.

21. L'aéroport Transfère réservé par Alps Accommodation Transfers sont fonctionnés et courent par le S.A.R.L GoMassif. Alps Accommodation ne sera pas tenu responsable ou responsable des problèmes qui relatent aux transferts.

22. Alps Accommodation ne prend pas la responsabilité pour toute restauration par les traiteurs externes.

23. Toutes les descriptions présentes sur ce site Web sont données en toute bonne foi et sont normalement correctes. Tous les autres aspects sont également concernés, notamment les informations et le tarif des activités.

24. Où l'accès à Internet de WiFi est offert ni Alps Accommodation ni le propriétaire accepte responsabilité si ceci n'est pas disponible pour tous ou certaines de la location, et aucun remboursement sera offert où ceci est le cas.

25. Afin d'éviter tout doute en cas de conflit, les clauses des Conditions générales prévalent sur tout autre document.

26. Tous les utilisateurs de ce site conviennent que la version en langue anglaise l'emporte sur toutes les traductions dans une autre langue.

Terms and Conditions for Owner Managed Properties

1. Once the “booking request” form is submitted, you agree that Alps Accommodation can pass this information to the owner of the property.  The owner of the property will then contact you directly to confirm the booking and to make the deposit or full payment with them. 

2. Until you have made payment directly to the property owner and completed their booking information the booking is not deemed confirmed and we recommend not making any travel arrangements.

3. The reservation is made directly with the property owner and all further contact is made with them in relation to this booking request.  Any queries relating to the booking process and for assistance in resort, must be made to the property owner, or any other parties as instructed by the property owner, not Alps Accommodation.

4. The exact details of what elements are included in the property price, is as listed on the “owner services” box on your chosen accommodation page.  Further details will be provided to you by the property owner.

5. While Alps Accommodation does its best to ensure the properties advertised are an exact replication of the website advert, Alps Accommodation cannot be held responsible for any alternations to the property and its contents.  Should the property not meet the expectations of the group, this must be raised directly with the property owner.

6. Any complaint relating to the condition of the accommodation, must be made to the owner.

7. Alps Accommodation reserves the right to increase or decrease the price of unsold holidays at any time.

8. Alps Accommodation is not and does not become party to any contractual relationship or financial transaction between you the guest and the owner.

9. Alps Accommodation will not be held responsible for the services provided in resort by the property owner or their “in resort management” or for any companies recommended on the Alps Accommodation website, including but not limited to ski schools, ski hire organisations, nanny services and flexible catering.

10. Transfers booked through Alps Accommodation Transfers are operated and run by S.A.R.L GoMassif. Alps Accommodation will not be held responsible or liable for any problems relating to the transfers.

11. Alps Accommodation will not be held responsible for any illness or accident occurred as a direct or indirect result of using a hot tub, sauna or swimming pool at owner properties.  Usage is entirely at the guests own risk.

12. Alps Accommodation reserves the right to contact the guest at any stage of the booking process, to include a contact email for feedback after the holiday.

13. All descriptions on the website are given in good faith and believed to be correct. This is in relation to all aspects including, but not limited to owner property information, activity pricing and resort information.

14. Alps Accommodation does not accept any liability for personal injury or death wheresoever or howsoever arising caused to any visitor and/or any member of the group for their duration of stay in the property owner accommodation. This is not intended to exclude any statutory rights the group and/or visitor may have.
